✅ Commonly Notarized Online (Eligible)

Most documents requiring a Commissioner of Oaths can be completed via secure video call. These include:

  • Affidavits & Declarations: OSAP Affidavits, Common-Law Status, RIN (Vehicle Transfer) forms, and Affidavits of Service.

  • Family & Personal: Travel Consent Letters for children, Invitation Letters for visas, and Separation Agreements.

  • Government & Business: ServiceOntario/ServiceCanada forms, IMM (Immigration) forms, Pension attestations, and commercial agreements.

  • Legal & Estate: Ontario Wills and Powers of Attorney (Note: These require specific virtual witnessing protocols).

❌ Documents That Cannot Be Notarized Online

Certain documents are ineligible for remote services because they require physical inspection or "wet ink" signatures under current regulations:

  • Certified True Copies: Per the Notaries Act, a notary must physically inspect the original document (e.g., Passports, Birth Certificates, Driver’s Licenses) to certify a copy. This cannot be done via webcam.

  • Documents for Foreign Use: Documents intended for use outside of Canada often require a physical "wet ink" signature and an embossed seal to be accepted by Global Affairs Canada or foreign consulates (Authentication & Legalization).

  • Negotiable Instruments: Promissory Notes, Loan Agreements, or Letters of Credit typically require in-person signatures.

  • Passport Applications: Statutory Declarations in Lieu of a Guarantor for Canadian Passports often require an in-person appearance.
